I. General conditions
1. Agreement (hereinafter - Agreement) - the purchase and sale agreement of the relevant Services and/or Goods concluded between the Buyer and the Seller, which is considered to be concluded from the confirmation of the Order, i.e from the moment when the order is placed. The terms of each Agreement by the Parties shall be deemed to be identical to the terms of present Rules and such Agreements shall always be performed by the Parties in accordance with the Rules below.
2. Seller (hereinafter - the Seller) - a person specified in the Service Order, whose Service and/or Goods are sold on the website senkapis.lt, in accordance with these Rules, is responsible for the execution of the order submitted by the Buyer. In accordance with these Rules, the legal details of the Seller with whom the purchase and sale agreement of the respective Service is concluded, shall be specified in the Order.
3. The Buyer (hereinafter - the Buyer) is a person at least 18th years old, whose capacity is not restricted by the court order, in possession of full authority and rights to conclude and carry out the agreements offered by the senkapis.lt website and who has created his/her personal account on the website senkapis.lt before submitting the Order.
4. The Parties (hereinafter - the Parties) are the Buyer and the Seller together.
5. The Service - the works performed and the goods supplied indicated on the Seller’s website senkapis.lt.
6. Order (hereinafter - the Order) - an order of Services and/or Goods, which indicates the Services and/or Goods that the Buyer would like to purchase from the Seller, specified in the same Order. This electronic document is the Services purchase and sale Agreement between the Parties.
7. The term for the Order execution (hereinafter - the Term) - 10 working days from the date of concluding the Agreement between the Parties or, if the Order has been revised, 10 working days from the revision of the Order. During the 1st and 2nd of November, Mother’s Day (first Sunday of May) and Father’s Day (first Sunday of June) the deadline is extended to 15 working days.
II. Rules
1. The Agreement between the Parties shall be deemed initiated from the moment when the Buyer has fulfilled following conditions on the website senkapis.lt:
- has created a shopping cart in "My Account,
- has provided the delivery details,
- has selected the payment method and acknowledged these Rules,
- clicks on the "Order" button
2. The registration performed on a website senkapis.lt by the Buyer in "My Account" section, on the basis of the Terms of Use, creates the Buyer account which stores his/her personal data and Order history.
3. The owner of the website senkapis.lt reserves the right to change the names of categories, services, goods and other names at his sole discretion and without prior notice to registered users.
4. The Buyer must pay for the Goods and their delivery, as well as for other payments (if any of it is specified at the time of conclusion of the Contract). The Buyer pays for the submitted Order according to the chosen payment method and using online banking.
5. If the data provided in the Buyer's registration form changes, the Buyer must immediately provide to the Seller the updated information by the contact means specified on the senkapis.lt website. In this case, the Order Execution Term starts from the day of data adjustment in the Order.
6. The Buyer has the right to money refund if the Order was carried out with a poor quality or was delayed. The Buyer shall inform the Seller making a claim about the poor quality of the Order by means of contacts indicated on the website senkapis.lt. After the claim has been analyzed, the amount paid by the Buyer will be returned to the Buyer's original account within 30 working days from the submission of the claim.
7. In case of damage caused by the Buyer's fault (e.g. by entering inaccurate or incorrect data into the Order and without notice to the Seller), the Buyer will compensate to the Seller the direct losses occurred due to his fault.
8. In the absence of the possibility to deliver an identical item according to the Order and displayed on photos of the senkapis.lt website, the Seller reserves the right to change the item or a part of it, maintaining the same items or its parts value, composition and color.
9. Superior force (force majeure)
9.1. The Party will be exempted from responsibility for not completing the Contract, if it proves that the contract has not been performed due to the circumstances beyond its control and which was not reasonably predictable at the time of conclusion of the Contract. Force majeure is not considered to be the absence of the necessary goods on the market or the impossibility of the Party to have the necessary financial resources.
9.2. If the circumstance due to which it is impossible to perform the Contract is temporary, the Party will be released from responsibility only for a period of time that is reasonable considering the influence of that circumstance on the performance of the contract.
9.3. The Party which has not fulfilled the contract is obliged to notify the other Party about the occurrence of the circumstance specified in paragraph 9.1 of this Article and of its effect on the performance of the contract. If the notification is not received by another Party within a reasonable time after the Party who has failed to fulfill the Contract has become aware or had to find out about that circumstance, the latter Party must compensate the losses occurred due to failure to receive the notification.
9.4. The provisions of this Article shall not preclude the right of another Party to terminate the Contract or suspend its fulfillment, or to demand the payment of interest.
9.5. If the image of the arranged object has changed due to the theft or natural phenomena after the confirmation of the Order fulfillment (sending a photo or video to the contacts indicated in the Order form),the Seller shall not indemnify the Buyer.
III. Privacy policy
When processing your personal data, we comply with the General Data Protection Regulation (hereinafter - GDPR), the Law of Legal Protection of Personal Data of the Republic of Lithuania.
1. You have the following rights and obligations:
1.1. To know (be informed) about the processing of your personal data, require the correction or addition; clarification of incorrect, inaccurate, incomplete personal data.
1.2. Require the destruction of Your personal data when it is no longer required for the purposes for which it was collected. Upon receipt of your request, we will reply to you within 30 working days after receiving it and within 30 working days after the submission date of any documents necessary for the reply. The requirements shall be submitted by means of contacts provided on senkapis.lt website.
1.3. If you believe that your rights have been violated under the GDPR, you can issue a complaint to our supervisory authority - the Lithuanian State Data Protection Inspectorate. More information and contact details can be found on the Inspectorate's website (www.ada.lt).
IV. The concept of personal data and its use
1. Personal data is considered as any information related to an identified or identifiable natural person (data subject). Natural person is a person, who can be identifiable, directly or indirectly, in particular by an identifier such as name and surname, personal identification number, location data and internet identifier or on the basis of one or more characteristics of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
2. The Buyer, as a registered User is responsible for storing or transferring his login data to third parties. If the Services provided by the senkapis.lt are used by a third party, the User who has logged in to the senkapis.lt website using the Buyer's login data, shall be considered as a Buyer for the Seller.
3. The Privacy Policy applies to all persons who have visited the senkapis.lt website, as well as to the actions that can be performed on this website.
V. Rights and obligations of services Seller
1. The administrators and owners of senkapis.lt website assure that they do not provide and make available Your personal data to third parties, except the cases specified in the Privacy Policy or the cases within applicable laws, when the User navigates on the website and certain information is collected automatically (e.g. type of web browser used, number of visits to the website, reviewed pages and descriptions of the website).
2. Your personal data are collected due to:
2.1. Registration (creation of “My Account” on the senkapis.lt website), identification and execution of the Order;
2.2. Payment of the submitted Order;
2.3. The assurance of communication and Order fulfillment quality.
3. The administrators and owners of senkapis.lt website do not request supply and do not manage your special categories personal data, revealing your racial or ethnic origin, political standpoints, religious or philosophical beliefs or membership within the trade unions, as well as health data or data about your sexual life and sexual orientation. In case if you provide us with this data using senkapis.lt website or by other communication means, it will be deemed that this data has been provided with your consent. Accordingly, we will process this data together with other.
VI. Price, payment and warranty period
1. The prices of the Goods and/or Services in the online store and in the formed Order are indicated in Euros including VAT.
2. The buyer shall pay for the goods and/or Services in one of the following ways:
2.1. The payment by bank transfer is the advanced prepayment where the Buyer transfers money by online banking or by the bank office according to the Order Confirmation;
2.2. PaySera;
2.3. PayPal;
2.4. ViPPS;
2.5. Visa Mastercard.
3. The Parties agree that after the Buyer submits the Order and the after the Seller confirms it, the price of the goods in the Order may vary depending on objective indicators affecting the price of the goods, such as an increase in the cost of the goods, technical errors of information systems, additional expenses related to goods selling to the Buyer. The Seller has the right to terminate the Agreement by notifying the other Party.
4. The Seller does not provide the warranty services for goods and/or services. The Seller cannot provide a warranty for live flowers in pots, planting flowers or to the products from cut flowers.
5. The Buyer can find the detailed information regarding the warranty conditions of services and/or goods by contacting the Seller at the contacts indicated on the senkapis.lt website.
If you use the senkapis.lt website, you have read and agreed with its Privacy Policy and for the purposes, methods and procedures of data processing specified therein. If you do not agree with a Privacy Policy and the Terms and Conditions, you are not entitled to use the senkapis.lt website.
